SC returns Imran Khan's 'frivolous' petition against PM Nawaz

ISLAMABAD: Supreme Court Registrar on Tuesday returned the reference filed by Pakistan Tehreek-e-Insaf chief Imran Khan against Prime Minister Nawaz Sharif.

PTI on Monday requested the SC to probe the Panama Leaks and disqualify Prime Minister Nawaz Sharif for allegedly lying in the National Assembly regarding his assets.

Imran Khan, filed a petition under Article 184(3) of the Constitution through his counsels Hamid Khan, Naeem Bukhari and others, praying to unseat Premier Nawaz Sharif, his son-in-law Captain (retd) Muhammad Safdar, Member National Assembly, and Finance Minister Ishaq Dar.

The petition filed by PTI stated that Panama Leaks have become a concern for the entire public and that money from Pakistan has been illegally stashed away in offshore accounts.

The petition calls for the Supreme Court to place the prime minister’s name on the Exit Control List.

"This petition prima facie appears to be a frivolous petition within the contemplation of Order XVII Rule 5 of the Supreme Court Rules, 1980”, the SC order stated.

"Certificate provided at page 26-A of this Constitution Petition does not fulfill the requirements of a Certificate as required under Rule 6 of Order XXV of the Supreme Rules, 1980."

"This petition prima facie appears to be a frivolous petition within the contemplation of Order XVII Rule 5 of the Supreme Court Rules, 1980", the order stated.

"The petitioner is directly invoking the extraordinary jurisdiction of the Supreme Court under Article 184(3) of the Constitution, which is not permissible in terms of judgment reported as 1998 SCMR 793 (Zulfiqar Mehdi. Vs. PIA, etc.)"

In April, the largest document leak, Panama Papers, had initially named some 200 and later on 400 more people, including businessmen and politicians from Pakistan, the family members of Premier Nawaz Sharif included in the list for establishing offshore companies in a tax haven.
