Treason case: Court saves verdict over criminal code application
ISLAMABAD: Barrister Akram Sheikh, special public prosecutor in the treason case against former president Pervez Musharraf, said on Wednesday that there is no flaw or weakness in the formation of the special court, Geo News reported.

A three-judge bench of the special court headed by Justice Faisal Arab was hearing the treason case against Pervez Musharraf.

While presenting his arguments, lawyer of Pervez Musharraf, Anwar Mansoor said that according to section 13 of the special court act, criminal code can not be applied to it.

During the proceedings, prosecutor Akram Sheikh presented his arguments in favour of the formation of the special court and its powers. He said that there is no weakness or vacuum in the formation of special court and if there is, then state or other general laws will be applied at that point.

Treason case proceedings are of criminal nature and the Supreme Court has already declared that crimes under Army Act will be tried under criminal code. The special court has powers beyond the high court. In 1980, the Supreme Court had declared that criminal code will be applied to all such occasions where special law is not applied.

The court saved the judgment on the application of criminal code on special court after listening to the arguments. Justice Faisal Arab said that the order will be announced in few days or next week.
