PESHAWAR: President Supreme Court Bar Association (SCBA) Asma Jehangir Saturday stressed the need for having a regulation in connection with the use of suo motto notice by the Supreme Court of Pakistan, and asserted that high courts enjoy no such power to take suo motto notice under the Constitution.
Talking to Geo News following a meeting of SCBA Executive Committee in Peshawar, Asma Jehangir said the Supreme Court has the power to take a suo motto action but added that the use of this authority should be brought under a regulation.
She, however, said that the Bar was split in two opinions regarding the use of the suo motto notice.
"The high courts are not authorized to take suo motto notice under the Constitution but they continue to use it unchecked," the SCBA President said.
